CHAPTER VI. ELECTIONSCHAPTER VI. ELECTIONS\Article 1. City Elections

(a)   Non-partisan general elections for members of the governing body shall be held on the Tuesday succeeding the first Monday in November, 2016, and succeeding elections for governing body positions shall be held each year on such date thereafter for such governing body positions whose terms are expiring.

(b)   Those governing body positions with terms that would have expired in April, 2016 shall expire on the second Monday in January of 2017, when the City officials elected in the November 2016 general election take office. Those governing body positions with terms that would have expired in April 2017 shall expire on the second Monday in January of 2018, when the City officials elected in the November 2017 general election take office.

(c)   The governing body shall consist of a mayor and two (2) council members from each ward. There shall be elected in November of each odd-numbered year a mayor and one (1) council member from each ward. There shall be elected in November of each even-numbered year one (1) council member from each ward. The council members shall be chosen by the qualified electors of their respective wards, and no person shall be eligible to hold the office of council member who is not at the time of his or her election or appointment an actual resident of the ward for which he or she is elected or appointed, and if any council member shall move from the ward from which he or she was elected or appointed, the office as council member shall thereby be vacated. The mayor and council members shall be residents and qualified electors of the City of Russell, Kansas.

In accordance with K.S.A. 25-205, and amendments thereto, any person may become a candidate for city office elected at large by having had filed with the county election office either of the following:

(a)   a declaration of candidacy, accompanied by any fee required by law; or

(b)   a nomination petition. The nomination petition must be signed by five qualified electors of the city.

All officers elected or appointed, except the city manager, shall be qualified electors of the city and the removal from such city of any officer shall occasion a vacancy in such office. A vacancy in the office of council member shall be filled by majority vote of the governing body to fill the vacancy for the unexpired term of that council position. In case any person elected as a council member neglects or refuses to qualify within thirty (30) days after election, the council member shall be deemed to have refused to accept the office and a vacancy shall exist.

The City of Russell is hereby divided into four wards as hereinafter set forth in this article.

Ward No. 1. All that portion of the City of Russell , Kansas, north of the center of the Union Pacific Railroad right of way bounded on the west by Brooks Streets extended to the north city limits boundary line thence east along the north city limits boundary line to the east city limits boundary line thence south along the east city limits boundary to the Union Pacific Railroad right of way.

Ward No.2. All that portion of the City of Russell, Kansas, lying west of Brooks Street extended to the north city limits boundary line and lying north of the center of the Union Pacific Railroad right of way, and all of that portion of the city lying west of Lincoln Street and south of the center of the Union Pacific Railroad Right of Way and more particularly described as commencing at the intersection of the center of the railroad right of way and Lincoln Street, thence South along Lincoln Street to Jewell Street thence west on Jewell Street to Windsor Street thence south on Windsor Street to Dorrance Street, thence west on Dorrance Street to Van Houten Street thence north on Van Houten Street to the center of the railroad right of way then east along the center of the railroad right of way to the point of beginning.

Ward No.3. All that portion of the City of Russell, Kansas, commencing at the intersection of the center of the Union Pacific Railroad right of way and Lincoln Street then south along Lincoln Street to Jewell Street then west on Jewell Street to Windsor Street then south on Windsor Street to Dorrance Street then east on Dorrance Street to Main Street then south following the west city limit boundary line to Edwards A venue, then bounded by and along city limits on the west, south and east to Homer Road then west along Homer Road to Front Street then north on Front Street to Sunset Avenue then east on Sunset Avenue to Seitz Street then north on Seitz Street to State Street then west on State Street to Fossil Street then north on Fossil Street to the center of the Union Pacific Railroad right of way then west along the center of the Union Pacific Railroad right of way to the point of beginning.

Ward No. 4. All that portion of the City of Russell, Kansas, commencing at the intersection of the center of the Union Pacific Railroad right of way and Fossil Street then south on Fossil Street to Eighth Street a.k.a State Street, thence east on State Street to Seitz Street then south on Seitz Street to Sunset Avenue then west on Sunset Avenue to Front Street then south on Front Street to Homer Road then east, north, and south along the south city limits back to Homer Road then east on Homer Road to the intersection of Homer Road and 186th Street then north along the east city boundary line to the center of the Union Pacific Railroad right of way thence west along the center of the railroad right of way to the point of beginning; and any other portions of the City of Russell, Kansas, not includes in Wards One, Two or Three.
