There is hereby established a Municipal Court for the City of Russell, Kansas. The Municipal Court shall have jurisdiction to hear and determine cases involving violations of the ordinances of the city.

Except as specifically provided otherwise (e.g., Charter Ordinance No. 19), the Kansas code of procedure for Municipal Courts, as set forth in K.S.A. § 12-4101 et seq. and all acts amendatory or supplemental thereto shall govern the practice and procedure in all cases in the Municipal Court.

The municipal court shall be presided over by a municipal judge who shall be appointed by the city manager.

The Municipal Judge shall have such powers and duties as set forth in the Kansas code of procedure for Municipal Courts

The Municipal Judge shall receive a salary as shall be fixed by ordinance.

If the municipal judge is absent, sick, or disqualified from acting, the city manager shall appoint some suitable and proper person to be municipal judge pro tem until such absence, disability or objection shall cease.

The governing body may provide at the expense of the city a suitable room or officer for the municipal judge and he or she shall hold court in such room and the court shall be open every day except weekends and legal holidays. Municipal court shall be held at the municipal courtroom unless circumstances make that place impracticable for a particular session, in which case it may be held at any convenient place in the city.

The City of Russell, does hereby specifically provide that Russell City Municipal Court costs shall be seventy-five dollars ($75.00) to be assessed to each and every case filed in the Municipal Court of the City of Russell, Kansas.
