Article 6. Oaths And Bonds

All officers and employees of the city, whether elected or appointed, either under the laws of the State of Kansas or ordinances of the city, shall before entering upon the duties of their respective offices, take and subscribe an oath or affirmation as follows:

       “I do solemnly swear (or affirm) that I will support the Constitution of the United States and the Constitution of the State of Kansas and faithfully discharge the duties of (here enter name of office or position). So help me God.”

All officers and employees required by law to take and subscribe or file any oath or affirmation, shall be supplied the necessary forms for such purpose at the expense of the city and upon taking and subscribing or signing of any such oath or affirmation, the same shall be deposited with the city clerk: Provided, That the oath of the city clerk, required by section 1-601 of this article shall be filed with the city manager.

Before entering upon the duties of their respective offices, the following officers shall give good and sufficient surety bonds to the city conditioned for the faithful performance of all of their duties of their respective offices in the following amounts:

(a)   City Manager - $10,000;

(b)   Treasurer, Firemen’s Relief Association - $1,000;

(c)   Treasurer, Library Board - $5,000;

(d)   City Treasurer - $30,000.

All other officers and employees of the city and all subdivisions thereof, except those specifically mentioned in section 1-603 of this article, may be bonded, at the discretion of the governing body, under a blanket position bond in such amount as may be deemed advisable from time to time by the governing body.

In all cases where corporate surety bonds are given, the premium on the bonds provided for under section 1-603 and 1-604 of this article, shall be paid by the city except that the bond of the treasurer of the Firemen’s Relief Association shall be paid from the fund of the Firemen’s Relief Association and the bond of the treasurer of the library board shall be paid from the library funds. In addition thereto, the Library Board shall pay its proportionate shares of the cost of the blanket position bond provided for in section 1-604.

The bonds of all officers and employees shall be filed with the city clerk. All bonds shall be approved as to form by the city attorney and shall be approved as to surety by the governing body.

No person shall perform any of the duties of the office to which he or she is appointed or elected without first having given the bond as herein required.

All bonds mentioned or referred to in section 1-603 and 1-604 of this article shall be for a term of one year and no person shall continue to perform the duties of any office for which a bond is required after the bond has expired or has been canceled or is not otherwise in effect unless another bond has been given and approved.
